Credit Eligibility Information

Credit eligibility information” refers to personal information obtained from a credit reporting body (e.g., a consumer credit report) or personal information derived from such information, which is used to assess your creditworthiness. The types of credit-related information we might collect include:

  • Information that assists us in assessing your suitability for credit.
  • Information about your credit history with other credit providers.
  • The likelihood of you meeting your financial obligations based on your past history.

Credit-related information means:

  • Credit information: This includes information about your identity, the type, terms, and maximum amount of credit provided to you, including the timing of repayment, repayment history, default information, financial hardship arrangements, court proceedings, and publicly available information.
  • Credit eligibility information: This is information about you supplied to us by a credit reporting body, including information that we derive from it.

We use credit-related information to assess your eligibility for finance and to manage that finance. We may exchange this information with credit and finance providers and credit reporting bodies.


AI Policy and Data Usage

Entrusted Lending utilizes artificial intelligence (AI) to enhance our services, such as assisting brokers with email composing activities, loan assessments, and automating parts of our customer service. We do not use customer data, including email data obtained through Google Workspace APIs, to develop, improve, or train generalized AI or machine learning models.

Your personal information, including email contents, is used only for the purposes of providing our services to you, and is not used for the development or training of AI models. We are committed to ensuring that your data is not shared for AI model development, and we take steps to ensure that customer data is securely handled in all aspects of our service.

This transparency ensures that you are fully informed about how your data is used, and we comply with regulatory requirements that govern data usage for AI.


Why We Collect Your Personal Information

We collect and receive personal information about you (including credit-related information) for the following purposes:

  • To conduct our business, including assessing your application for finance, establishing your identity, and managing your finance.
  • To comply with legal obligations, including those under the Privacy Act 1988 and the Credit Reporting Code.
  • For direct marketing purposes, to inform you about services or products you might find useful.
  • To improve our services and offer you new products or services.

If you apply for a finance broker role with us or if you apply for employment, we will collect information to assess your suitability for the role and manage the relationship with you.


How We Collect Your Personal Information

Where reasonable and practical, we will collect your personal information directly from you. This may include:

  • Information provided through online forms, emails, or phone conversations.
  • Data entered into our websites or mobile applications.

We may also collect information about you from publicly available sources, such as public registers, social media, or through third parties, including credit reporting bodies, finance brokers, employers, and other service providers.


Do We Disclose Your Personal Information?

We may disclose your personal information to third parties such as:

  • Funders and intermediaries in relation to your finance requirements.
  • Service providers, such as valuers, surveyors, call centres, or IT contractors.
  • Legal authorities and regulatory bodies, where required by law (e.g., under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006).
  • Businesses we have a relationship with that may want to market products or services to you.
  • Other parties with your consent, or as required to fulfill our obligations under applicable laws.

We ensure that third parties receiving your information have a commitment to protecting your data in a manner at least equal to our own.


Credit-Related Information

We may exchange your credit-related information with credit reporting bodies, such as Equifax, Experian, and Illion, for the purposes of assessing your eligibility for finance and managing that finance.

We may store credit-related information both in electronic and paper formats. We use cloud storage to store personal and credit-related information, and some data may be stored overseas, but we ensure that all appropriate security measures are in place.


Notifiable Data Breaches

Under the Notifiable Data Breaches Scheme, we are required to notify you and the OAIC if a data breach is likely to cause serious harm to individuals. If we believe a data breach has occurred, we will notify affected individuals and advise on steps to mitigate the impact.


Direct Marketing

From time to time, we may use your personal information to provide you with information about offers or services that may interest you. You can opt out of receiving such marketing communications at any time by contacting us or using the unsubscribe function in emails.

If you’re not satisfied with the response, you may escalate the matter to the Australian Financial Complaints Authority (AFCA) or the OAIC.
